Marcelino has threatened to take Rayo Vallecano chairman Martin Prensa to court over comments comparing him to a Lufthansa pilot who deliberately crashed a plane.
Rayo were relegated on the final day of last season as Sporting Gijon stayed up following a 2-0 win over Villarreal, who have been accused of deliberately not trying to win the game.
"Marcelino Garcia Toral is like that crazy Lufthansa pilot who crashed a plane," the Rayo chairman had told Punto Pelota on Saturday.
Prensa appeared to be referring to the March plane crash where a pilot was thought to have deliberately crashed a plane, killing all 150 people on board.
"I'm publicly asking Martin Prensa to retract his comments," said the former Villarreal manager.
"I am not a murderer and this comparison is beyond awful.
"Martin Prensa has insulted me and if he does not withdraw his comments and publicly apologise then I will take him to court."
Less than half an hour before Marcelino made those comments, Rayo published a clarification on their website regarding Prensa's comments.
Prensa apologised as the comparison was 'not the luckiest' and he did not wish to offend anybody.
